EU to UK trademark conversions from 1 January 2021
UK clones of EU registrations
All registered European trademarks will be automatically cloned by the UKIPO by 1 January 2021.
The cloning procedure will result in an independent and separately renewable UK trademark at no cost to the owner of the EU right.
Each of the UK trademark rights will:
- will appear as a registered UK trademark on the UKIPO trademark register
- will have equal legal status to those applications filed and registered in the UK
- will retain the same priority and filing dates as the EU trademark
- will be a UK trademark that is entirely independent from its EU counterpart
Equivalent provisions exist for EU designs.
To provide your clients with a UK address for service London IP can record itself as representative for UK clones.
There is no charge for London IP to record itself as agent in respect of any UK trademark or design clones.

UK conversions of pending EU applications
Any European trademark/design applications that are still pending on the day of Brexit will not be cloned.
Instead it will be necessary for applicants that wish to obtain UK trademark protection to re-file the trademark application at the UKIPO within a period of 9 months from the end of the transition period, i.e. up to (and including) 30 September 2021.
The new UK trademark application will retain the earlier filing date of the pending EU trademark application.
The total cost of a smooth UK one-class trademark registration through London IP is GBP550, with additional classes costing GBP100 on filing. These figures are inclusive of our fees, official fees, and disbursements.
If any issues arise (e.g. objections during examination or third-party oppositions) then our fees are predominantly on a time-spent basis.
